Solano County is considering regulatory options for medical marijuana related operations in the unincorporated areas of the county. As part of this decision-making process, Solano County is embarking on a public outreach effort to discuss and gather input on a range of options and approaches to addressing medical marijuana activities in unincorporated Solano County.

County staff expects to return to the Board of Supervisors in December 2013 with the results of the public outreach effort. A draft ordinance and the analysis of the impact of implementing the ordinance are anticipated for Board review in early summer 2014.
There is currently a ban on medical marijuana dispensaries in the unincorporated areas of the county. The ban was adopted on July 30, 2013 and includes a sunset provision to expire on July 29, 2014.

Given the complexity of State and Federal laws pertaining to marijuana and medical marijuana, and recent Federal directives and court cases that affect how medical marijuana can be addressed at the local level, the County is evaluating its options for addressing the potential placement of medical marijuana dispensaries and related activities prior to the end of the current medical marijuana dispensary ban.
In drafting the ordinance staff will consider various operational parameters for medical marijuana dispensaries, including minimum separations from sensitive uses, safety provisions, design and appearance standards, parking, and safe handling of materials.

Staff will also evaluate other issues related medical marijuana, including possible rules on where and how medical marijuana is cultivated, the monitoring of collectives, and other public health protections. These rules could be adopted by the Board independent of any decision regarding medical marijuana dispensaries.
